Helpling.ai Terms of Service

1. Introduction

These Terms of Service ("Terms") form a legally-binding contract between you ("User", "you") and Dan Rowland trading as Helpling.ai ("Helpling.ai", "we", "us") governing your use of the Helpling.ai websites, applications, APIs and any related services (collectively, the "Service"). By creating an account, clicking "I agree", or otherwise accessing the Service, you accept these Terms and ourUsage Policy. If you do not agree, do not use the Service.

2. Eligibility & Account Registration

  • You must be at least 18 years old and able to form a binding contract.
  • You must provide accurate registration information and keep it up to date.
  • You are responsible for all activity that occurs under your credentials and for keeping your password confidential.

3. Description of Service

The Service enables you to:

  • Upload your own text and data to fine-tune a dedicated GPT model;
  • Generate articles, product descriptions and other content via that model;
  • Chat with the model through a browser interface or documented API;
  • Store, edit and manage the generated content inside the platform.

4. Subscriptions, Fees & Payment

  • The Service is offered on a subscription basis; plan tiers and pricing are shown at checkout.
  • All fees are charged in GBP and are exclusive of VAT unless stated otherwise.
  • Subscriptions renew automatically unless cancelled in your account dashboard before the renewal date.
  • We use Stripe to process payments; you authorise Stripe to debit your chosen payment method.
  • Except as required by law, payments are non-refundable.

5. Fair-Use & Technical Limits

Each subscription includes monthly usage caps (fine-tuning jobs, uploads, generated outputs, chat messages) detailed in theUsage Policy. We may throttle, queue or reject requests that exceed your plan's limits.

6. Your Content & Intellectual Property

  • Ownership. You retain all rights in the text, data and files you upload ("User Content").
  • Licence to us. You grant Helpling.ai a worldwide, non-exclusive licence to store, process and transform User Content solely to operate and improve the Service (including training and maintenance of your model).
  • Generated Output. As between you and us, you own the content generated for you by the Service ("Output"). OpenAI assigns any rights it may have in the Output to you, subject to its API Terms of Use.
  • Feedback. Suggestions you provide may be used by us without obligation.
  • Responsibility. Helpling provides AI-generated text and images. Users are solely responsible for the legality, accuracy, and appropriateness of any generated text or images they choose to generate and publish.

7. Data Protection & Privacy

  • We process personal data in accordance with our Privacy Policy.
  • OpenAI acts as a sub-processor; you may enable OpenAI's data-usage opt-out in your settings.
  • We implement reasonable technical and organisational measures to protect your data.

8. Prohibited Conduct

You must comply with the Usage Policy. In particular, you may not:

  • Upload or generate any content listed as "Prohibited Content" in that policy;
  • Use the Service for unlawful, harmful or deceptive purposes;
  • Attempt to reverse engineer, probe or bypass security or rate-limits;
  • Resell, lease or share your account without our written consent.

9. Service Availability & Changes

  • We aim for 99.9 % uptime but do not guarantee uninterrupted service.
  • We may modify, suspend or discontinue features; where practicable we will give 30 days' notice of any material change.

10. Term & Termination

  • These Terms remain in effect while you have an account.
  • You may cancel at any time via your dashboard; access will continue until the end of the current billing cycle.
  • We may suspend or terminate the Service or your account immediately if you breach these Terms or the Usage Policy.
  • Upon termination we will permanently delete your fine-tuned model and associated data within 30 days, except where retention is required by law.

11. Disclaimers

  • The Service and Output are provided "as is" without warranties of any kind.
  • You acknowledge that AI-generated content may contain inaccuracies and must be reviewed before publication.
  • None of your data is backed up, it's your responsibility to make sure you back up your articles and data.

12. Limitation of Liability

To the maximum extent permitted by law, Helpling.ai's total liability for any claim arising out of or relating to the Service is limited to the greater of (a) £100 or (b) the amounts you paid to us for the Service during the 12 months preceding the claim. We shall not be liable for any indirect, consequential, exemplary or punitive damages.

13. Indemnification

You will indemnify and hold harmless Helpling.ai, its directors, employees and affiliates from any claim arising out of your Content, your use of the Service, or your breach of these Terms.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of London (UK) shall have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction.

15. Dispute Resolution

  • Please contact us first; most disputes can be resolved informally within 30 days.
  • If not resolved, the dispute shall be submitted to the courts as per Section 14.

16. Changes to Terms

We may update these Terms to reflect legal or operational changes. We will give at least 7 days' notice via email or in-app notice. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

18. Facebook / Meta Data Deletion

Helpling.ai uses Facebook Login (provided by Meta Platforms, Inc.) to allow users to sign in with their Facebook account. When you connect via Facebook Login, we receive your Facebook user ID and, if granted, your public profile information (name, profile picture).

To request deletion of all data Helpling.ai holds that originated from your Facebook account, you have two options:

  1. Delete your Helpling.ai account. Go to your account dashboard → Settings → Delete Account. This permanently removes all personal data we hold, including any data received via Facebook Login, within 30 days.
  2. Email us directly. Send a deletion request to legal@helpling.ai with the subject line “Facebook Data Deletion Request”. We will confirm deletion within 30 days.

We do not share your Facebook data with third parties beyond what is described in our Privacy Policy.
